In Bell Atlantic Corp v. Twombley, the U.S. Supreme Court limited antitrust lawsuits, making it easier for defendants to win dismissal prior to extensive discovery. In its decision, the Court determined that a complaint will withstand a motion to dismiss if it includes factual allegations sufficient to give plausibility to the underlying its claim in the complaint.
